Many General Counsels are seeking greater predictability surrounding the legal costs. As a result, a growing number of legal departments have begun exploring alternatives to the billable hour. A popular option within the wide range of alternative fees is paying for legal services by task (instead of by the hour). Examples of services our clients have purchased as “per task items” cover the full spectrum of legal services, including services provided by law firms as well as ancillary legal services (e.g., court reporting or trial graphics services). Specific per task items include (but are not limited to) witness depositions, mock trials, trial animations, document hosting, the discovery phase of a legal matter.

Quality in a service is not what the supplier puts in. It is what the customer gets out and is willing to pay for. Customers pay only for what is of use to them and gives them value. Nothing else constitutes quality.

Argopoint has deep experience in helping clients scope out law firm and other legal service provider engagements with a focus on determining fair value for specific tasks. Past projects typically involved:

  • Analyzing past billing data
  • Researching market trends
  • Identifying engagement types (e.g., spectrum of outside engagements within each practice area)
  • Isolating discrete tasks within each engagement type
  • Developing and implementing “per task” billing models

Our expertise in researching and developing cost per task models has provided our clients with a range of billing options. We have found that some legal services are very well-suited to per task costing, while others are better suited to hourly or per engagement rates. The decisions surrounding the appropriateness of specific billing models for specific services emerge from strategic conversations within the legal department. Our research and models provide legal department leaders with the data to utilize alternative fees with confidence.
